Do you Need a Medical Marijuana Card to Purchase THC in Nebraska?

           If you have found this article, then I am sure that you have seen the signs for where to buy THC products around your town in Nebraska. There has been a ton of them popping up, and the talk of “cannabis dispensaries” and the need or lack of a need for a “medical marijuana card” (or often referred to as a “medical card”). We also touch on cannabis dispensaries, as well as briefly addressing the ongoing issue of medical marijuana in Nebraska.

Does Nebraska Have Medical Marijuana?

            The short answer: Absolutely NOT. The law in Nebraska on marijuana currently does not allow for medical marijuana (as most people know it). A group known as ‘Nebraskans for Medical Marijuana’ has recently attempted to place medical marijuana on the ballot the last two election cycles and the measurement has failed at both attempts: the most recent being in 2022. The first time in the recent past (2020) the petition for medical marijuana had enough signatures from the voter base in Nebraska, however the Nebraska Supreme Court (NSC) threw out the votes and the petition because it had both recreational and medical marijuana on the petition. The NSC essentially implied that it was too confusing for voters as they wouldn’t realize they were voting for both medical & recreational marijuana legalization.

            The second attempt for the legalization of just medical marijuana happened just this year in 2022. There was two initiatives purposed: one of which would have been the pathway for legal medical marijuana and the second initiative would have nullified and made inactive any current archaic laws on marijuana from the past. They would have needed 180k signatures from registered Nebraska voters in order for both measures to pass, unfortunately the petitions fell slightly short of that number.

            This means us Nebraskans must wait until 2024 to be able to put marijuana on the ballot again. There is only one pathway until then that is a possibility, but not very likely, and that is unless it passed through legislation by the Nebraska Unicameral and approved by the Nebraska Supreme Court, otherwise we will be waiting until 2024 and will most likely have to petition for it.

 

Do I need a medical card in Nebraska to purchase THC products?

            No, as of November 2022; in the State of Nebraska - you should never need a “medical card” to purchase Delta 8 THC or any other cannabinoid in the state of Nebraska. This may change in the future if the State of Nebraska ever does provide a pathway to legal marijuana.

            At this point you might be asking yourself, then why do I see signs saying “No Medical Card Needed”? or “Cannabis Dispensary”? The reason you are seeing this is because of what is known as “manipulative marketing”. These places are purposefully misleading you and misinforming you so they can sell you a product.

           The reason THC products are available for legal purchase in the State of Nebraska without a “medical card” is because on December 18th 2018, then President Donald Trump signed into law the “Agriculture Improvement Act of 2018” – Also known as (The 2018 Farm Bill). By passing this bill it allowed for the grow, cultivation, and sale of hemp products and hemp derived products that have a 0.3% Delta 9 THC ratio or less by volume. 

No Medical Card Needed in Nebraska for Cannabis THC Products

Are “cannabis dispensaries” in Nebraska Licensed? 

            No, there are ZERO licensed cannabis dispensaries in Nebraska. As of right now, even if companies wanted to be licensed, the State of Nebraska has no pathway for them to do so. As far as oversight on these places referring to themselves as a cannabis dispensary, well there is none; the only thing they have to make sure of is that the product has less than 0.3% delta 9 THC and that the person making the purchase is 18 years or older with a valid photo ID.         Some may find companies using the term “cannabis dispensary” a bit misleading but this is not necessarily what we would categorize as ‘misinformation’ and the reasoning is because of the definitions of the term “cannabis”.

           Now that we know what the definition of “cannabis” is we can see pretty clearly that places referring to themselves as “cannabis dispensary” are not actually lying directly to the consumer. However we do understand how it could be seen as a bit misleading because of the more “commonly understood” definition of “cannabis” and the pre-perceptions that most people have when referring to the term cannabis.

 

What is required In the State of Nebraska to purchase THC products? 

            In the State of Nebraska as of November 2022, all you need to purchase hemp derived THC products is a valid photo identification proving that you are over the age of 18 years old. The other item we would recommend is: to do your homework on the place you are purchasing products from. If a business is misrepresenting who they are or what they are selling that should be a huge RED FLAG for you as the consumer. Keep in mind you are going to be intoxicated by the products you are about to purchase, these products should be made in a GMP certified facility at the very least, not shuffled together in the back of a retail store.
